An Abuja-based Lawyer, Maxwell Opara, has dragged President Muhammadu Buhari, the Inspector General of Police, Usman Alkali Baba, the Attorney General of the Federation, Abubakar Malami SAN, and the Nigerian Police Council before the Court of Appeal, Abuja, over the recent extension of the tenure of the IGP by President Muhammadu Buhari.
In the court process made available to TheNigeriaLawyer, Mr. Maxwell is seeking an interlocutory injunction restraining the 1st, 3rd and 4th Respondents (being the President, IGP, AGF and Police Council respectively), whether by themselves, their agents, servants, privies and/or otherwise howsoever called from empowering, allowing or backing the current occupant of the office of Inspector – General of Police or any other person by which ever name called who is not a serving Police officer from occupying the office of the Inspector – General of Police as from the 1st day of March, 2023, pending the hearing and determination of the motion on notice.
According to the Motion on Notice dated 19th of January, 2023, the application is based on four grounds, which are as follows:
1. The Applicant has an Appeal pending before this Court on whether the 1st Respondent has the power to allow any occupant of the office of the Inspector – General of Police continue to stay in office after he is no longer a serving Police officer.
2. That while this Appeal is pending and adjourned for hearing, the 1st Respondent has announced his intention to allow the current occupant of the office of the Inspector – General of Police to continue to occupy the office after he is no longer a serving Police officer.
3. That the res in this matter are in imminent danger of being destroyed.
4. That there urgent need to hear this application and the appeal expeditiously."
The motion was accompanied with a 24-paragragh affidavit wherein the Applicant made averments strongly opposing the extension of the IGP's tenure by the President.
A day for hearing the motion is yet to be fixed as at the time of filing this report.
